Resumo O artigo discute os trinta anos da Constituição Federal de 1988 sob a perspectiva da mudança a ser operada, e obstáculos a tais transformações tanto no debate intelectual, como no papel do Poder Judiciário, notadamente no Supremo Tribunal Federal. Esvaziada em seu sentido original de seu caráter desenvolvimentista, dirigente e garantista, por concepções teóricas americana e europeia recepcionadas no Brasil, a Constituição restou incapaz de revelar-se instrumento contra o golpe de 2016 e seus desdobramentos econômicos e políticos.

Abstract The article discusses the thirty years of the Federal Constitution of 1988 under the perspective of the change to be operated, and obstacles against such transformations in both the intellectual debate and in the role of the Judiciary, especially the Federal Supreme Court. Depleted in its original sense of its developmental character, directive and guarantor, by American and European theoretical conceptions assimilated in Brazil, the Constitution remained incapable of proving itself an instrument against the coup of 2016 and its economic and political consequences.

Resumo O artigo discute o fenômeno da Constituição Dirigente, apontando que diversas Constituições promulgadas ao longo dos séculos XX e XXI em países periféricos buscam vincular o legislador a um projeto constitucional, estabelecendo, assim, uma linha de atuação política que garanta a progressiva construção, através do Direito, de uma nova realidade social e econômica que permita a superação do subdesenvolvimento.

Abstract The article discusses the phenomenon known as Directive Constitution and points out that several constitutions enacted in the 20th and 21st centuries in peripheral countries seek to bind the legislature to a constitutional project, thus establishing a political line of action that ensures the progressive construction - through the law - of a new social and economic reality, therefore overcoming underdevelopment.

O presente texto oferece uma análise histórica das limitações à soberania popular plena nos Estados Unidos desde a Independência até o início do século XX, destacando o papel ativo da Suprema Corte no combate à ampliação da democracia norte-americana. O empenho da Suprema Corte na extensão da garantia dos direitos dos proprietários de escravos antes da Guerra Civil revela a força da rejeição da mesma Suprema Corte à realização dos direitos fundamentais incorporados à constituição pelas 13a. e 14ª. Emendas, depois da Guerra Civil, transformando o discurso da "Constituição de todos" na realidade da "Constituição invertida".

The text presents a historical analysis to the limits of the full popular sovereignty in the United States from the Independence to the beginning of the 20th century, focusing on the active role of the Supreme Court as an opponent to the expansion of the North-American democracy. The vigorous efforts of the Supreme Court in order to extend the warrants of the slave owner's rights before the Civil War reveal how strong the same Court repelled the recognition of fundamental rights incorporated to the Constitution by the 13th and 14th Amendments after the Civil War, transfiguring the "everyman's Constitution" speech into the reality of the "inverted Constitution".

O presente artigo busca analisar as tensas e complexas relações entre política e Constituição, desde a célebre polêmica sobre o antagonismo entre democracia e constitucionalismo, passando pelos paradoxos da formalização excessiva do direito constitucional, o direito político por excelência. O método exclusivamente jurídico do direito público vai ser posto em xeque no debate da República de Weimar pela nova Teoria da Constituição, que busca incluir o político na análise constitucional. No segundo pós-guerra, o debate se dará entre as teorias materiais e processuais da constituição, buscando dirigir ou excluir a política da Constituição. Tendência esta de exclusão que chega ao ápice com os tribunais constitucionais e o esvaziamento do debate sobre política e legitimidade no direito constitucional contemporâneo, que necessita, na opinião do autor, de uma "volta à política" para sair do impasse em que se encontra.

The article explores the tense and complex relationships between Politics and Constitution, from the famous discussion about democracy and constitutionalism, through the paradoxes of the juridical formalism of Constitutional Law, the Political Law par excellence. The exclusively juridical method of Public Law was contested in the Weimar Republic debate on the new Theory of Constitution, which strove for include the Political in the constitutional analysis. In the second Post-war period, the debate has oscillated between Substantive and Procedural theories of the Constitution, both striving for conducting Politics or excluding it from the Constitution. This trend culminates in the Constitutional Courts and the empting of the debate about politics and legitimacy in contemporary Constitutional Law, which needs, according to the author, the "return to Politics" to get out of its present deadlock.
