O crescimento da demanda por serviços em setores de infraestrutura, associado à falta de investimentos públicos, induziu políticas de promoção da participação privada. No setor portuário isso se deu no início da década de 1990, quando o crescimento do comércio internacional decorrente do aumento da globalização evidenciou a ineficiência generalizada desse setor. Este artigo tem por objetivo discutir a participação privada no setor portuário a partir da análise de formas de organização e evolução do setor em diferentes países, analisando os possíveis modelos de competição associados a diferentes estruturas de propriedade em áreas do porto. O artigo inova em relação à literatura ao especificar a propriedade privada de áreas de uso restrito localizadas dentro do porto. O artigo apresenta, ainda, a evolução e a organização atual do setor portuário brasileiro. Ao longo da discussão, exemplos de portos são apresentados para ilustrar os conceitos apresentados.

The growth in demand for services in the infrastructure sectors, coupled with the lack of public investment, led to policies to promote private participation in those sectors. In the port sector, the private participation started in the early 90s, when the growth of international trade resulted from increasing globalization has highlighted the generalized inefficiency of this sector. This article aims to discuss the private participation in the port sector from the analysis of ways of organization, as well as the evolution of this sector in different countries, analyzing the possible competition models associated to different ownership structures in the areas of the port. The article also presents the evolution and the current organization of the Brazilian port model. Throughout the discussion, examples of ports are presented to illustrate the discussed concepts.

El crecimiento de la demanda de servicios en los sectores de infraestructura, junto con la falta de inversión pública, condujo políticas de promoción de la participación privada. En el sector portuario la participación privada recibió impulso a principios de 1990, cuando el crecimiento del comercio internacional y creciente globalización ha puesto de manifiesto la ineficacia general de este sector. Este artículo tiene como objetivo discutir la participación privada en el sector portuario desde el análisis de las formas de organización en esto sector en los distintos países y los modelos de competencia asociados a las diferentes estructuras de propiedad en las zonas del puerto. El artículo innova en relación con la literatura mediante la propuesta de la propiedad privada de zonas de uso restringido en el puerto. El artículo también presenta la evolución y organización actual del sector portuario brasileño. A lo largo de la discusión, los ejemplos se presentan para ilustrar los conceptos presentados.

Este artigo oferece um método alternativo de precificação de tarifa do transporte de passageiros por ônibus. O modelo é implementável em situações de indisponibilidade de dados econômico-financeiros históricos por parte do regulador para estabelecer o rol de tarifas. O modelo apresentado se vale dos conceitos do modelo de regulação price-cap. Um coeficiente do tipo fator-X, no price-cap, é utilizado para a determinação da tarifa de forma a incentivar ganhos de produtividade. Esse fator é um índice de atividade da indústria de transporte de passageiros por ônibus ou da própria linha de ônibus. A literatura acadêmica de gestão financeira sugere diversos índices de atividade, sendo um deles a razão entre receita e ativo imobilizado líquido que é empregado nesse artigo. Por fim, o modelo é capaz de estabelecer o limite superior e o inferior para a tarifa-lance de forma a reduzir o espaço para comportamentos oportunistas por ocasião do leilão.

This article offers an alternative method model for pricing passengers coach service in regulated markets. The method implementation has low cost and is suitable to situations where the regulator has no historical economic and financial data to establish the tariffs based on the cost of service. Furthermore, it does not require complex calculations neither is based on unverifiable historical financial or market data. The model draws on the concepts of the model of price-cap regulation. A coefficient of type X-factor in price-cap is used to determine the productivity gains in order to induce future efficiency on the service provision. In this article, the model is applied to a hypothetical case of passenger transportation by bus and thus the X-factor is defined as an index of industrial activity of passenger coach services. The financial economic literature defines several levels of activity, one of them is the ratio between revenue and net fixed assets. Moreover, the proposed model is used to establish upper and lower limits for the tariff-bid, reducing possible opportunistic behavior at the auction.

A doutrina jurídica referente ao transporte rodoviário interestadual de passageiros (TRIP) não estabelece o início da oferta do serviço diferenciado na respectiva linha do serviço convencional. Este artigo mostra que se pode fixar calendário para o início desse serviço no TRIP. O calendário é construído à luz de um ramo da teoria de economia financeira, especificamente, da teoria das opções reais. Demonstra-se que é possível ter: (a) linhas sem a oferta do serviço diferenciado durante toda a permissão do serviço convencional, (b) linhas que ofertarão o serviço anos após o início da permissão do convencional e (c) linhas que ofertarão imediatamente o serviço diferenciado. Defende-se que as normas que dispõem sobre o TRIP sejam emendadas. Advoga-se que a metodologia proposta seja empregada pelo ente regulador do transporte interestadual de passageiros por ônibus para se determinar se e quando uma dada linha deve ser servida por serviço diferenciado.

The Brazilian legal doctrine on interstate bus passengers (TRIP) gives to the concessionaire the option to supply a premium service alongside to the conventional one during the concession period. Not being on obligation, the concessionaire is free to access the private benefit from supplying this premium service. This article argues that this option should be regulated by the Regulatory Agency. By doing so, the value of the option could be internalized by the regulatory framework, as well as a timetable for the commencement of the premium service. The schedule is constructed in the light of a branch of the theory of financial economics, specifically the theory of real options. Demonstrates that it is possible to have: (a) lines without the offer of differentiated service throughout the permission of the conventional service, (b) the service lines that will supply years after the start of permission from the conventional and (c) lines immediately supply the differentiated service. It is argued that the legal doctrine on the TRIP has to be amended. The argument is that the proposed methodology is employed by the regulator of interstate transportation of passengers by bus to determine if and when a given row must be served by different service.

RESUMO Este artigo discute a influência da estrutura de propriedade sobre a eficiência. A estrutura usada é a teoria do incentivo, na qual o principal deve construir um esquema de incentivos, o que induz um agente a agir de maneira ideal. Primeiro, verificamos os motivos da intervenção pública em indústrias com falha de mercado. A seguir, estudamos a deterioração da estrutura de incentivos sobre os gerentes como resultado da mudança de propriedade. Assim, verificamos como a estrutura de incentivos pode ser restaurada com a privatização da empresa, com a manutenção, pelo governo, de algum controle sobre a empresa. Por fim, fazemos uma breve exposição sobre os instrumentos regulatórios.

ABSTRACT This article discusses the influence of the ownership structure over the efficiency. The framework used is the incentive theory, in which the principal must build an incentive scheme, which induces an agent to act optimally. First, we verify the reasons for public intervention in industries with market failure. Following, we study the deterioration of the incentive structure over managers as a result of the ownership change. So, we verify how the structure of incentives can be restored with the firm’s privatization, with the maintenance, by the government, of some control over the firm. Finally, we make a brief exposition about the regulatory instruments.
