Resumen Una violación de los derechos humanos implica un no cumplimiento de los derechos humanos y una relación causal activa entre agentes humanos y tal incumplimiento. Esta relación causal puede ser de interacción, pero también puede ser institucional, como cuando los agentes colaboran en el diseño y la imposición de arreglos institucionales que de manera previsible y evitable causan el no cumplimiento de los derechos humanos. Cierta evidencia de fácil acceso sugiere que (a) derechos humanos sociales y económicos básicos siguen siendo incumplidos en casi la mitad de la población del mundo y (b) que el diseño de arreglos institucionales supranacionales juega un papel decisivo en la explicación de por qué la mitad más pobre de la humanidad está sufriendo un rápido descenso en su participación (ahora por debajo de tres por ciento) en el ingreso doméstico global. Abstract A human rights violation involves unfulfilled human rights and a specific active causal relation of human agents to such non-fulfillment. This causal relation may be interactional; but it may also be institutional, as when agents collaborate in designing and imposing institutional arrangements that foreseeably and avoidably cause human rights to be unfulfilled. Readily available evidence suggests that (a) basic social and economic human rights remain unfulfilled for around half the world's population and (b) the design of supranational institutional arrangement plays a major role in explaining why the poorer half of humanity is suffering a rapid decline in its share (now below three percent) of global household income. A strong case can be made, then, that people like myself - well-to-do citizens of influential states - collaboratively violate the human rights of the global poor on a massive scale.

With strong resonance across cultures, the word "dignity" has become increasingly prominent in international law and in discussions of global justice. It is used in two distinct but closely related senses. In one sense, dignity is a high worth which all human beings possess as human beings and which commands that they be treated with respect and consideration. In another sense, dignity is a characteristic of human lives that, for many, remains yet to be achieved. Because human beings have dignity in the first sense, it is imperative to enable them to lead a life with dignity. This paper explicates the two related senses of "dignity" and explores how they can inform and support a conception of global justice and efforts at its realization.

Con profundas resonancias que atraviesan distintas culturas, la palabra "dignidad" se ha vuelto cada vez más prominente tanto en la legislación internacional como en discusiones sobre justicia global. Se la emplea en dos sentidos distintos pero estrechamente relacionados entre sí. En un sentido, la dignidad es un alto valor que todos los seres humanos poseen en cuanto tales y que exige que sean tratados con respeto y consideración. En otro sentido, la dignidad es una característica de las vidas humanas que, para muchos, permanece aún como un objetivo por alcanzar. Puesto que los seres humanos tienen dignidad en el primer sentido, permitirles llevar una vida con dignidad en el segundo sentido es imperativo. En este artículo se explican los dos sentidos de "dignidad" mencionados, al tiempo que se explora cómo pueden dar forma y sustento a una concepción de justicia global y a los esfuerzos por implementarla.

El uso generalizado de la expresión “justicia global” indica un cambio en la estructura del discurso moral. Tradicionalmente, las relaciones internacionales se consideraban como algo distinto de la justicia nacional. Antes se centraban en las interacciones entre los Estados, y luego se consideró el diseño del orden institucional nacional a la luz de sus efectos sobre los ciudadanos. Ese análisis moral institucional se empieza a aplicar a los arreglos institucionales supranacionales, hoy más influyentes e importantes en la vida de las personas. La perspectiva tradicional sugería acuerdos justos entre los Estados. La nueva perspectiva muestra que el orden institucional global es injusto pues enriquece a las élites de los países ricos y pobres, y perpetúa la opresión y el empobrecimiento de las mayorías.

The increasingly widespread expression “global justice” marks an important shift in the structure of moral discourse. Traditionally, international relations were seen as sharply distinct from domestic justice. First, it focused on interactions among states, and later, evaluated the design of a national institutional order in light of its effects on citizens. Such institutional moral analysis is becoming applied to supranational institutional arrangements, nowadays more pervasive and important for the life prospects of individuals. The traditional lens suggested fair agreements among states. The new lens shows that the global institutional order is unfair because it enriches elites in both rich and poor countries and perpetuates the oppression and impoverishment of the majority.

There are more books and essays on 'global justice' in this millennium already than in the preceding one, at least as far as computers can tell. Some of the broad topics currently debated under the heading of "global justice" have been discussed for centuries, back to the beginnings of civilization. But they were discussed under different labels, such as "international justice", "international ethics," and "the law of nations." This essay explores the significance of this shift in terminology. Distinctive of the philosophical framework associated with the increasingly prominent expression "global justice." is the focus on the causal and moral analysis of the global institutional order against the background of its feasible and reachable alternatives. Within this general global-justice approach, distinct conceptions of global justice will differ in the specific criteria of global justice they propose. But such criteria will coincide in their emphasis on the question of how well our global institutional order is doing, compared to its feasible and reachable alternatives, in regard to the fundamental human interests that matter from a moral point of view. Extending institutional moral analysis beyond the state, this question focuses attention on how today's massive incidence of violence and severe poverty, and the huge excesses of mortality and morbidity they cause might be avoided not merely through better government behavior, internally and internationally, but also, and much more effectively, through global institutional reforms that would, among other things, elevate such government behavior by modifying the options governments have and the incentives they face.

Ya existen más libros y ensayos sobre "justicia global" en este milenio que en el anterior, al menos según lo que indican las computadoras. Algunos de los temas más amplios que se discuten hoy bajo el título "justicia global" se vienen tratando desde hace siglos, inclusive desde el principio de la civilización, pero se los discutía bajo distintos rótulos, tales como "justicia internacional", "ética internacional" y "la ley de las naciones". Este ensayo explora el significado de tal desplazamiento en la terminología. Un rasgo distintivo del marco filosófico asociado con la expresión "justicia global" es el hecho de destacar el análisis causal y moral del orden institucional global contra el trasfondo de sus alternativas viables y alcanzables. Dentro de este enfoque general de la justicia global, las diferentes concepciones de la justicia global diferirán en los criterios específicos de justicia global que proponen. No obstante ello, esos criterios coincidirán en enfatizar la cuestión sobre cómo funciona nuestro orden institucional global en comparación con sus alternativas viables y alcanzables, en lo que respecta a los intereses humanos fundamentales que resultan relevantes desde un punto de vista moral. As privações sofridas pelas pessoas mais pobres dos países pobres devem ser entendidas, não como eventos pelos quais os mundialmente mais privilegiados não têm nenhuma responsabilidade, e sim como injustiças produzidas por uma estrutura institucional comum. A erradicação dessas privações, em conseqüência, depende de uma reforma nas instituições (sobretudo econômicas) globais. O artigo argumenta em favor de uma das propostas de reforma que têm sido discutidas: a introdução de um dividendo global que incidiria sobre a utilização de recursos naturais e sobre as atividades poluidoras. Os recursos arrecadados seriam destinados à erradicação da miséria no mundo todo.

The world's most privileged can not claim to be free of any responsibility for the deprivation suffered by the poorer of the poor countries. Such deprivation is the result of a common institutional framework, so it ought to be seen as injustice. Therefore, the erradication of radical deprivation depends upon a reform of our global institutions (chiefly the economic ones). Arguments are presented on behalf of one of the current proposals: the introduction of a global dividend to be applied to the use of natural resources and to pollution-led activities. The revenue can then be used to the emancipation of the global poor.
