Resumo: O presente trabalho busca refletir acerca do complexo fenômeno da politização do Supremo Tribunal Federal. Nos caminhos que vão do ativismo judicial ao populismo judicial, busca-se trabalhar cada uma das concepções sob as luzes da teoria da reputação judicial. No começo do século XXI, o Supremo Tribunal Federal demonstrava um alinhamento com a audiência acadêmica. Nesta segunda década do mesmo século, a partir das manifestações de junho de 2013, o Supremo Tribunal Federal começa a praticar um populismo judicial. Assim, mudam-se os parâmetros comportamentais impactando diretamente no conteúdo decisório.

Abstract: This paper aims to reflect on the complex phenomenon of politicization of the Supreme Court. In the paths that range from judicial activism to judicial populism, we seek to work each conception in the light of the theory of judicial reputation. At the beginning of the 21st century, the Federal Supreme Court showed an alignment with the academic audience. In this second decade of the same century, from the June 2013 demonstrations, the Supreme Court begins to practice judicial populism. Thus, the behavioral parameters are changed directly impacting the decision content.

Abstract The article seeks to explore the legal impact of the COVID-19 pandemic on our constitutional system. Starting from the differentiation between a state of exception and a state of constitutional emergency, the issue of facing the pandemic must have an answer within the framework established by the 1988 Constitution. Furthermore, the responses of public authorities have brought to light what federalism we intend to protect and materialize from the division of competences. The answer is an asymmetric and decentralized federalism to face the sanitary difficulties of the coronavirus. Finally, the pandemic enabled a critical rethink in the right to health and how the hegemonic theory of law tradition views it in a colonial perspective.

Resumo O artigo busca explorar o impacto jurídico da pandemia do COVID-19 em nosso sistema constitucional. Partindo da diferenciação entre estado de exceção e estado de emergência constitucional, a questão do enfrentamento da pandemia deve ter uma resposta dentro dos quadros estabelecidos pela Constituição de 1988. Além do mais, as respostas dos poderes públicos trouxeram à tona qual o federalismo que pretendemos proteger e concretizar a partir da repartição das competências. A resposta é um federalismo assimétrico e descentralizado para o enfrentamento das dificuldades sanitárias do coronavírus. Por último, a pandemia possibilitou um repensar crítico no próprio direito à saúde e como a tradição jurídica hegemônica o encara em uma perspectiva colonial.

Resumo: No artigo busca-se explorar as interseções entre gênero e cultura na diversidade do Constitucionalismo latino-americano. Baseando-se nos estudos de gênero decoloniais, a questão central é problematizar a Lei de proteção às mulheres do Estado Plurinacional da Bolívia. Ao mesmo tempo, o Constitucionalismo latino-americano é interpretado em seu pluralismo epistemológico que resulta de sua vinculação a movimentos sociais distintos. Para tanto, no artigo são exploradas as discussões de gênero na América Latina e a forma como as questões de gênero ganharam uma narrativa específica distinta da eurocêntrica.

Abstract: The article seeks to explore the intersection between gender and culture in the diversity of Latin American Constitutionalism. Based on the decolonial gender studies, the central question is to problematize the Law on the Protection of Women from the Plurinational State of Bolivia. At the same time, one must interpret Latin American Constitutionalism with its epistemological pluralism of distinct social movements. In order to do so, the article explores the gender discussions in Latin America and the way in which the gender issue gained distinct narrative of the Eurocentric narrative of gender.
