Female incarceration and legal basis of health care for women deprived of liberty in Brazil

Abstract

Background:

Female incarceration has grown significantly in recent years. The conditions imposed by prison can culminate in health problems, which could be minimized with the effective implementation of health policies in the prison system.

Objective:

The article aimed to reflect on the legal basis of health care for women in deprivation of liberty in Brazil, having as a background the expanded concept of health.

Methods:

Through the literature review, the main milestones regarding the rights to health care of incarcerated women were traced. Relevant aspects of female incarceration in Brazil were also outlined, as well as reflections on the particularities found in the prison system that culminate in the denial of health care rights to imprisoned women, a context regarded as a great challenge to the current Public Health Care.

Results and conclusions:

Based on this analysis, one can notice that even in the face of legal provisions, the health of women in deprivation of liberty has been severely neglected, which leads to the need for emergency changes in the care models of prison facilities, in line with the principles and guidelines of the Unified Health System (Sistema Único de Saúde – SUS).
