The aim of this work is to identify the perspective of the National Democratic Union Party with regard to public education and the constitutional linking of resources, as well as the reasons why the liberals supported this protected area of the budget despite their defense of a free market. It analyses the arguments for and against as well as the restrictions or opposition to it in the legislative process. The sources used were the annals and diaries of the National Constitutional Assembly of 1946, as well as pertinent literature. The victorious proposition is justified focusing on the limits of the State in the political dimension. Furthermore, party members perceived that the industrial development of Brazil depended on expansion of primary education.s
