Historical movement of the right to education for people with disabilities: prescriptions of the Brazilian Constitutions

Abstract

This article aims to discuss the right to education as a social right of all people with disabilities, safeguarded in the Brazilian Constitutions and educational legislation, as universal and a state duty established through policies based on democratic values: universalization of public, free and inclusive education, pillars of citizenship and of the Democratic State of Law. The document and bibliographic analyses involved the educational legislation, the Brazilian constitutions, and the theoretical studies of Saviani (2013), Horta (1998), Cury (2014), Vieira (2007), who discuss the concept of education as an inclusive, democratic, systematized, and constitutive process of a valued formative path, which expands the social possibilities, recognized and affirmed as the right to education for all. In order to materialize this right for people with disabilities, more than the prescriptions printed in the documents of the Brazilian State are required, there are required policies that expand the defense of a society based on human and universal values and respect for freedoms. It also requires efforts, strategies, and resources that lead to its realization and, in fact, contemplate its specificities and the needs of all.
