This article presents Franz Neumann as a Critical Theory representative. It discusses the central arguments of Neumann's The Rule of Law: Political Theory and the Legal System in Modern Society (1937), focusing on the theoretical impact of Weimar crisis on Neumann's thought. This impact motivates a reformulation of the concept of Law. In a context of politicization of capitalism, Law should not be conceived as mere superstructure, but as a necessary moment of the socialist revolution.
