Este artigo discute a tensão entre os dois elementos constitutivos do regime internacional de proteção aos direitos humanos: a afirmação de exigências normativas de caráter universal sobre os direitos subjetivos dos indivíduos e o ordenamento jurídico do Estado democrático, através do qual tais expectativas se traduzem em normas precisas, apoiadas em instituições capazes de zelar por sua efetividade. O artigo trata, portanto, do paradoxo entre o universalismo dos direitos humanos e o particularismo inerente ao Estado. Depois de discutir o tema no plano conceitual, o artigo examina a tensão em dois contextos históricos distintos: os Estados Unidos e a América Latina, extraindo daí algumas ilações a respeito das relações políticas no hemisfério.

This article discusses the tension between the two constituent elements of the international regime for the protection of human rights: the universal normative demands on subjective rights of individuals, and the legal order of the democratic state, through which such expectations are translated into definite rules, supported by institutions strong enough to ensure their effectiveness. The article aims, therefore, the paradox between the universalism of human rights and the inherent particularism of the state. After discussing the issue at the conceptual level, the article examines how this tension manifest itself in two distinct historical contexts, the United States and Latin America, extracting from it some lessons about political relations in the hemisphere.

Os direitos humanos se encontram em fase de evidente desprestígio. Os motivos do descrédito não são apenas as violações que prosseguem, nem distorções decorrentes de valores não ocidentais. São também, e sobretudo, sua extensão conceitual exagerada, promovida pela esquerda culturalista pós-moderna, assim como a repetição inercial de ações e posturas, hoje anacrônicas, inerentes ao sistema de proteção internacional existente. Para recuperá-los em sentido construtivo é necessário voltar à Declaração Universal de 1948, atualizar o discurso originalmente construído contra ditaduras e readaptar o sistema à situação das democracias atuais ameaçadas.

Human rights are now in an evident lackluster phase. Causes of disbelief in them are not only their continuing violations, nor distortions that stem from non-Western values. First and foremost, they involve an exaggerated conceptual extension of those rights, promoted by the post-modern cultural Left, as well as the endless repetition of today anachronistic forms of action and positions inherent to the existing international protection system. In order to recuperate human rights on a constructive direction it is necessary to return to the Universal Declaration, of 1948, to update Lua Nova, São Paulo, 86: 253-260, 2012 255 Resumos / Abstracts a discourse that was originally built against dictatorships, and to re-adapt the whole system to the situation of present democracies under threat.

O objetivo deste texto é analisar, por meio da história recente dos movimentos sociais que lutam pela reforma agrária no Brasil, a construção do direito à terra como um direito humano. A partir dos anos de 1970, a interação de movimentos camponeses da Igreja Católica progressista e da rede transnacional de direitos humanos confluiu na produção dessa ideia da posse da terra como um direito humano, que marcou não apenas a luta pela terra no Brasil, como também influenciou a forma como o próprio movimento de direitos humanos foi construído no país e na maneira como ele se inseriu nessa rede transnacional de ativistas.

This article seeks to analyze, within the recent history of social movements that struggle for agrarian reform in Brazil today, the build of the land rights as a human right. Since the 1970s, the interaction between peasant movements, the progressive church and the transnational network of human rights has converged into this idea that the land rights are a human right, which not only has marked the character of the struggle for land in Brazil, but has also influenced the way in which the human rights movement has been constructed in the country and how it has taken its place within the transnational network of human rights activism.

Utilizando-se do conceito de frames, o artigo procura delimitar um master frames de direitos humanos entre organizações não governamentais brasileiras que orienta ações e ativismo destas. Analisa-se particularmente a atuação da Fundação Margarida Maria Alves, sediada em João Pessoa, na Paraíba, utilizando principalmente os boletins informativos editados pela organização. O exame de sua trajetória e frames master ilumina aspectos da construção de um master frames de direitos humanos no Brasil.

Using the frames approach, the paper attempts to outline a human rights master frames in force among nongovernmental organizations in Brazil that guides its actions and activism. This article examines in particular the work of the Margarida Maria Alves Foundation, based in João Pessoa, Paraíba, using mainly the newsletters published by the organization. The examination of its trajectory and organizationalframes master illuminates aspects concerning building a human rights master frames in Brazil.

Este artigo busca avaliar a criação da Comissão Nacional da Verdade no Brasil e o esforço desta para integrar direitos humanos e meios democráticos de apurar violações passadas. Primeiramente, ele tenta estabelecer uma visão normativa de acordo com a qual a Lei de Anistia de 1979 não é válida porque viola o que Rainer Forst chama de "direito básico à justificação". Além disso, revê e critica à fundamentação normativa das decisões da Corte Interamericana de Direitos Humanos, que recentemente condenou o Estado brasileiro. De acordo com a visão dessa corte, o único modo legítimo que um país tem de apurar violações de direitos humanos é via justiça criminal. Essa perspectiva, o artigo argumenta, é muito estreita e deve incluir também as comissões da verdade.

This paper aims to evaluate the creation of the National Truth Commission in Brazil and its effort to integrate human rights and democratic means to account past violations. First, it tries to establish a normative view according to which the Amnesty Law enacted in 1979 is not valid because it violates what Rainer Forst calls a "basic right to justification". In addition it reviews and challenges the normative foundations of the decisions of the Inter-American Court of Human Rights, which recently condemned the Brazilian state. According to the Court's view, the only legitimate way a country has to make violations of human rights accountable is by means of criminal justice. This perspective, the article argues, is too narrow and must include truth commissions as well.

Este artigo analisa a emergência e difusão da regra da responsabilidade criminal individual por violações de direitos humanos a partir da jurisprudência contenciosa da Corte Interamericana de Direitos Humanos. Tendo como referência as pesquisas de Kathryn Sikkink sobre justiça de transição, procura-se identificar a maneira como o Sistema Interamericano de Direitos Humanos vem expandindo o sentido da responsabilidade criminal individual e também sugerir a incompatibilidade com a proteção dos direitos humanos que esse novo modelo pode ter.

This paper analyzes the emergence and diffusion of the norm of individual criminal accountability for human rights violations from the perspective of the contentious jurisprudence of the Inter-American Human Rights Court. Taking as reference the research of Kathryn Sikkink on transitional justice, this paper seeks to identify how the Inter-American Human Rights System has been expanding the meaning of individual criminal accountability and also suggests the incompatibility with the protection of human rights that this new model may have.

A conceitualização latino-americana de direitos humanos não deve ser definida apenas em termos jurídicos, mas deve, também, incorporar uma dimensão sociopolítica, uma vez que a maior contribuição da região ao discurso está em sua filosofia de ação e na prática de seus movimentos sociais. Este artigo propõe uma conceitualização que resgate esse legado a partir de uma perspectiva discursiva, particularmente por meio das ideias de genealogia e intertextualidade.

A Latin American conceptualization of human rights would be sociopolitical rather than legal as the major contribution of the region to discourse has been its philosophy of action and the practice of social movements inspired by this philosophy. This article proposes a way to conceptualize human rights that recovers the historical legacy of social struggles from a discursive perspective, relying in particular on ideas of genealogy and intertextuality.
