Shelter, poverty and negligence: ways of judicialization

This work discusses the concept of negligence as a categorisation that justifies the intervention of the State in poor families, through the practice of sheltering children and adolescents. With the emergency of the Child and Adolescent Statute it becomes interdicted to shelter on behalf of poverty. For such, the lack of material resources becomes a weak justification and a new statute of criminalisation of poorness and judicialization of life is implanted, based on the disrespect of the rights established in the legislation: neglectful family. From this reference negligence comes to be produced as a device of affirmation of the society of security, having as parameter the biopolitical logic of the government of life.
