VIOLENCE AGAINST WOMEN: PROBLEMATIZING THEORETICAL, PHILOSOPHICAL AND LEGAL DEFINITIONS

Domestic violence against women is a multiple and complex phenomenon that has highlighted important theoretico-philosophical discussions and ethico-political questionings. This article aims to articulate the gender perspective to the analysis of violence, in the subjective, historical, social and cultural dimensions, seeking critic (re)readings about the definitions of these violences. The look on the sexist and patriarchal Brazilian culture reveals postures of legitimation and trivializing of these violences that recent legislation, such as the Maria da Penha Law, have tried to overcome. This law brings legal and procedural innovations that aim to take legal, political and cultural changes in the affirmation of human rights of women. By such perspective, we propose to discuss definitions and typifications of violences against women and articulate an understanding with the ethical and historical perspective of human rights. Thereby, incorporating the ethical and political dimension to the complex and critical look on domestic violence against women.
