Judicial review: could we take any advantage from the PEC 33/2011?

Abstract

This paper aims to analyze the relationship between the Judicial Power and the Legislative Power. It will be analyzed the reasons and the proposals from the Parliament to restrict the Supreme Court’s role in the judicial review and the academic debate between Ronald Dworkin and Jeremy Waldron, renowned legal scholars who significantly influenced the discussion about this theme. At the end, it will be some considerations about the PEC n. 33/2011 in order to check if the propolsal is nonsense, reasonable or beneficial for the subject.
