Difficulties to implement WTO reports: a case study on Brazil - tires case

The implementation of the decisions of the Dispute Settlement Body of the World Trade Organization has difficulties at national level. This debate could evolve legal, political and international relations aspects. The purpose of this article is to provide an analysis of some difficulties that the WTO system has to implement its decisions, from the perspective of a concrete case (Brazil - retreaded tires). Therefore, it is necessary in a first part to provide a quick evaluation of the instruments to induce compliance for, at a second part, present crucial obstacles of the Brazilian Government to implement the retreaded tires decision. We conclude that there is a dissociation between the internal and national arenas and the strong dependence of the World Trade Organization on national actors.
