What is the gender on STF? An analysis of the gender discourse found in the decisions of the Supreme Court Judges

Abstract

What do the Supreme Court Judges talk about when they talk about gender? The purpose of this article is to analyze how gender appears in the Brazilian Constitutional Court jurisprudence discourse. Based on a survey of judgments that mention the word "gender", 24 decisions were found and their sentences were examined, under the theory of performativity, in order to try to answer the question. Three main uses were highlighted and the excerpts were separated and examined according to a categorization of this usage (sex and gender; male and female gender and gender identity). In the end, an analysis of the normative production of gender and the production of relations between ideal and copy as a production of the heteronormative gender matrix is identified in the discourse examined.
