Conceptions of law and Interdict in the work of Pierre Legendre

Abstract

The article seeks to find points of intersection between psychoanalysis and criminology (critical). He seeks to develop a reading of the theory of the jurist-psychoanalyst Pierre Legendre which shows that the principle of paternity is the guarantee of access to Reason, that is, the guarantee of non-madness. That is to say, the principle of paternity is translated, first of all, by the establishment of the limit and, in this way, it passes through the Law. In this way, a reading of the fundamentals of criminal law and its basic anthropological questions is sought, discussing broadly the question of guilt and responsibility, as well as the relation of the subject to the criminal act and the need for punishment of the criminal who seeks in the judge, an external instance, the declaration of guilt.
