Basic Rights and the agonistic democracy: legal remarks on Chantal Mouffe´s political theory

Abstract

The main purpose of this article is to articulate the idea of an agonistic democracy developed by Chantal Mouffe and a broader conception of basic rights. One significant theoretical consequence would be exposing mechanisms that can promote further institutionalization in order to put limits and references to the conflict of perspectives without appealing to some sort of transcendental ground for the democratic practices.
