Emergency Measures in the Covid-19 Context

This article addresses the political and legal measures adopted by States with the purpose of facing crises of institutional nature, particularly the state of siege and the state of national defense, aiming to demonstrate their unsuitability to confront the Covid-19 pandemic. In addition, it analyzes the emergency measures adopted by Brazil in response to the health crisis, in order to discuss their legality and appropriateness under consideration of constitutional guarantees.
