Situating the trace: A philosophical proposal for the Theory of Legal Comparison

Abstract

This paper aims to provide the reader a new perspective in legal comparative studies. The so-called “philosophy of comparative law” or “cultural approach of comparative law” presents itself as a powerful interdisciplinary intellectual framework that provides the necessary inquiries for the realization of epistemological reflections in the field of comparative law. These reflections, rather than contributing to a refinement of the production of comparative legal studies, reinvigorate the debate around legal comparison and reverberant the importance of the field itself for the study of domestic law, reaffirming the importance of comparative studies for legal science.
