Profile of compulsory hospitalization processes due to drug use: a documentary research

ABSTRACT

Compulsory hospitalization, regulated by Law No 10.216/2001, is a phenomenon that involves two important areas: health and justice. Its use to face problems arising from drug use triggers the complexity of the issue and disagreements about the most effective way to treat the user. The objective of this study was to identify the profile of requests for compulsory hospitalizations resulting from the use of alcohol and other drugs. This is a documentary research that used judgments from the website of the Santa Catarina Court of Justice. Through the application of the keywords, 334 judgments were found and, of these, 92 were analyzed after evaluation criteria. The main variables collected were: identification of appellants and respondents, justification for the hospitalization request, legislation, existence of a detailed medical report and other aspects considered important to characterize the granting or rejection of requests. This study showed that justice and psychiatry have been responding to the urgency of normalizing deviant behaviors and conducts, with an expansion of biopower and justifying coercive interventions. Stigma about users contributes to enhancing these strategies, and legislation, created to avoid arbitrary measures, is used to strengthen segregation.
