This article begins with a comparative analysis of the reforms in penal legislation in Brazil and Argentina, identifying three areas of change: the expansion of Penal Law, the Emergency Penal Process, and the informalization of Penal Justice. The study attempts to contribute to the understanding of the criminal policy movements behind the legal reforms being examined.
