This paper, situated between law and sociology of law, deals with issues concerning the effectiveness of judicial defense of housing rights in Brazil, especially the legal proceedings involving informal settlements: slums, tenement dwellers etc. What is the legal discourse about housing rights? What is the live history of housing rights on brazilian courts? Those are our central questions. As result, we found a large distance between discourse and practice.
