The Governance of the Military Justice between Lisboa and Rio de Janeiro (1750-1820)1 1 This article is a product of the project "O governo da justiça militar: um estudo sobre legislação, ideias e práticas políticas entre Lisboa e Rio de Janeiro (1750-1889)" ("The Govern of the Military Justice: a study on legislation and political practices between Lisbon and Rio de Janeiro (1750-1889)"), sponsored by FAPERJ, which was being developed under a collective project entitled "Dimensões e Fronteiras do Estado brasileiro" ("Dimensions and Frontiers of the Brazilian State")- PRONEX - CNPq/FAPERJ. The general lines of this text were first discussed at a seminar taught by me at the Institute of Social Sciences, University of Lisbon (ICS / UL). The seminar was attended by Professors Nuno Gonçalo Monteiro and Fernando Dores Costa whom I thank for the suggestions, incorporated in this text. Abstract

The purpose of this article is to draw a historical outline of the constitution of the military justice field, centering the analysis in two moments. The first moment is that of the Pombaline Reforms. It is in this moment that the subject of the military justice is put on the agenda by Count Lippe. In 1763, it is possible to locate several charters issued with the intent to establish new authorities and to formalize the first instance of the military justice. In the center of the discussion was the military forum itself. A set of actions that will have continuity in the Marian-Johannine reign, and in this second moment, the priority aims were the second instance of the military justice and the codification of the military criminal legislation.
