Freud has presented the process of identification in the origin of the psychic apparatus. As a concept, though, it is marked by a few paradoxes. This article aims to formalize such impasses, as well as the necessary link, in a Freudian text, of the concept of identification with the guilt phenomenon. Throughout the text, a number of contemporary situations will be drawn upon, where within the areas of psychoanalysis and the judicial system, this link (identification-guilt) has come into serious question.
