This article intends to examinate the procedures in the Brazilian Parliament to the new National Plan of Education. It aims also to recover the evolution of the former plans. All of these plan have failed. After, considering the definition of plan and the new legal, social and political context, the article pursues to analyze the exposition of the plan's reasons, the law's text and its attached. Some themes continue present from the past as great challenges to be overcome. Among these themes we can distinguish the role of the Union in the Brazilian federal system, the colaboration's regime with the other members of the federation and the public funds for the education.
