The Agent Action or the Action Agent? Arrested Without Condemnation on the Periphery of Alagoas

ABSTRACT

It is known that the main targets of provisional incarceration are the perpetrators of property crimes. But is there a difference between them? The Agent Action or the Action Agent? Arrested Without Condemnation on the Periphery of Alagoas sought to know the social characteristic of prisoners without condemnation, accused of theft and fraud. The choice of crimes is based on the fact that, although the Brazilian criminal proceedings impose similar punishment to both types of criminal offences, the justice system has received in different ways their accused. The hypothesis of the research is that the agent of the action and not the action in has been the object of punishment.
