The Legal Contents of the Constitutional Principle of Quality Education Assurance: a contribution from the theory of fundamental rights

The Constitution stipulates a set of principles for education, including the assurance of quality standards. This article analyzes the meaning of such provision regarding basic education and provides a conceptual framework on its normative content, based on the theory of fundamental rights as principles, by Alexy. The principle intends to protect the highest quality of education according to the existing factual and legal conditions. From that point, we propose that the components of the right to quality education should be defined under the human rights approach, including the state's obligations to respect and protect the freedoms in education and hold it on equal terms. The right to quality has seven legal dimensions to be included in the processes of legal regulation and monitoring.
