Territorial sovereignty in dispute: the case of the intervention of the United Nations Stabilization Mission in Haiti and its impact on the territory

Abstract

The purpose of this article is to bring up a debate on disputed territorial sovereignty with a focus on the intervention of United Nations Stabilization Mission in Haiti (Minustah) in Haitian territory, based on the analysis that the sovereignty of the State to make a permanent and effective decision in any conflict that effectively tries to transform the unity of the territorial social, without excluding the positive law. We understand Sovereignty as one of the important tools for the State to realize and fulfill its objectives, methods, and principles within its jurisdictional limits. For each of them, it thinks its action as much autonomous within a territory like a technical base or the sectors of intervention. We analyze the consequences and implications brought by Minustah and other humanitarian aid to the country, questioning in what sense they ensured and reestablished the institutional normality and the sovereignty of the Haitian territory. In order for the consequences of such a mission to be identified, a bibliographic analysis is carried out. Added to it is the analysis of documents and information in both national and international bodies, scientific articles, books and dissertations that deal with the actions of the UN and Minustah in Haitian territory and the fragmentation of its sovereignty.
