Resolution number 267: the citizenship rescue of the people with epilepsy

INTRODUCTION: The world has witnessed significant transformation in many scientific fields, such as in technological area with the manufacturing of advanced vehicles and the use of high tech equipments, as well as, in medicine with the progress of treatments in medical disturbances that did not have many therapeutic options, such as epilepsy. A significant advancement in epidemiology, concerning to vehicle conduction, brought the need of studying the imposition of parameters regarding the driving license of the people with epilepsy (PCE). METHODS: Review of literature. RESULTS: In Brazil the Consent Group in 1999, composed by "Associação Brasileira de Medicina de Tráfego" (ABRAMET), "Associação Brasileira de Epilepsia" (ABE) and "Liga Brasileira de Epilepsia" (LBE), conducted the "The National Policy for Conduction of Automotor Vehicles by PWE", that was presented to "Câmara Temática de Saúde do Conselho Nacional de Trânsito" (CONTRAN), that was based on the article 147 of Law number 9.503 of September, 23, 1997, which instituted that "to be qualified as a driver, the applicant should be submitted to the exam of physical and mental capability", and with the Resolution number 80/98 of "Conselho Nacional de Trânsito", rules were established to regulate the proceeding of the exam, without specific reference to epilepsy, but including and adopting it according to the legal point of view, in conditions that restricted or did not indicate, by medical criteria, the vehicle conduction. After less than a decade, such conditions had to be reviewed, upgraded and modified in face of the needs of new view of the Law. CONCLUSIONS: Nowadays it is necessary a wide view of citizenship as well as a traffic law more sensible to the rights of the PCE.
