El artículo busca mostrar la importancia que la teoría del pouvoir neutre de B. Constant/ tuvo en la interpretación que Carl Schmitt hace de las funciones del Reichspräsident, en los años veinte hasta el nazismo. Aun cuando Schmitt critica al romanticismo, del cual al autor de Adolphe es una figura clave, igualmente reconoce que Constant teorizó la institución constitucional más adecuada para enfrentar las situaciones críticas, cuando la constitución debe autodefenderse mediante poderes legales pero excepcionales.

The article tries to show the importance that Constant's theory of the pouvoir neutre had on Carl Schmitt's interpretation of the functions of the Reichspräsident, during the twenties up to 1933. Even though Schmitt criticises Romanticism, one of its key figures is precisely Constant, the german jurist recognizes that Constant elaborated the constitutional institution which faces better than any other one those critical situations, under which any constitution must defend itself with legal but excepcional powers.

O artigo aborda o tema do realismo político no pensamento de Carl Schmitt, à luz de suas reflexões sobre o direito e a história da política internacional no mundo moderno. Para tanto, o texto analisa sua narrativa sobre a constituição da ordem das relações internacionais a partir do século XVI, apresentada no livro Der Nomos der Erde im Völkerrecht des Jus Publicum Europaeum (O Nomos da Terra no Direito Internacional do Jus Publicum Europaeum). Essa análise busca pôr em evidência a maneira como Carl Schmitt concebe a relação entre direito e realidade na época moderna e, com isso, pretende apresentar uma imagem do seu realismo político que leve em conta algumas de suas premissas históricas e filosóficas.

The article deals with the political realism theme in the way of thinking of Carl Schmitt, in the light of his reflections on law and history of international politics in the modern world. For that purpose, the text analyses his narrative on the establishment of international relations order from the sixteenth century, as presented in the book Nomos der Erde im Völkerrecht des Jus Publicum Europaeum (The Nomos of the Earth in the International Law of Jus Publicum Europaeum). This analyses looks forward to place in evidence the way Carl Schmitt conceives the relation between modern age law and reality, and, by this, intends to present an image of his political realism that takes into account some of his historical and philosophical premises

El presente trabajo desarrolla distintas figuras que Carl Schmitt señala como formas de subjetividad antipolítica. Si desde la perspectiva del jurista alemán las operaciones que constituyen un modo de ser político son aquellas que producen o sostienen una forma representativa, lo propio de una subjetividad antipolítica son aquellas operaciones que erosionan o conducen a la destrucción de dicha forma política. El trabajo intenta mostrar que la operación fundamental en este sentido es la dilación, entendida como la postergación indefinida de la decisión. Así, bajo las diversas figuras de la antipolítica que Schmitt aborda, esta operación también adquiere diversas formas de aparición: en el caso de la subjetividad liberal se da bajo la forma de la discusión y el compromiso, en el caso del romántico político bajo la forma de la poetización.

This paper develops various figures noted by Carl Schmitt as forms of anti-political subjectivity. Whereas, from the German jurist's perspective, the operations which constitute a political way of being are those which produce and care for a representative form, the specificity of a anti-political subjectivity is shaped by those operations which erode or wear that political form down. The paper aims to show that the main feature of the antipolitical way of being is the delay, meaning the indefinite postponement of the decision as such. Thus, under the various figures of the anti-politics that Schmitt deals with, this operation appears on different manners: the liberal form of postponing is the endless discussion and the compromise; the romatic form is the aesthetization of the world.

O artigo procura demonstrar que ocorre, no pensamento de Carl Schmitt, a fusão entre a figura do legislador tal como tratada na Antigüidade e aquela do soberano moderno. Resulta disso que o conceito de exceção passa a ocupar o núcleo da vida política.

The article tries to demonstrate that in Carl Schmitt's thought, there is a fusion between the concept of ancient legislator and that of modern sovereign. The result is that the concept of exception became nuclear to the political life.

O artigo analisa a questão da democracia em Carl Schmitt. Para tanto, retoma seu conceito de forma política que inclui identidade e representação. Após apresentar uma distinção fundamental para a noção de democracia, deriva algumas conseqüências do contraste com as idéias de Schmitt. A representação e a identidade como formas políticas constituiriam, então, uma impossibilidade para a democracia.

This article analyses the question of democracy in Schmitt's work. For this purpose, it reviews his concept of political form which includes identity and representation. After presenting a fundamental distinction to the notion of democracy, some consequences are derived from contrast to Schmitt's ideas. The representation and the identity as political form would constitute, consequently, an impossibility for democracy.
