O que queremos dizer quando dizemos que um indivÃduo A tem direito a X? O artigo discute esta questão esclarecendo os fundamentos dos direitos (em particular, mas não só, dos direitos humanos) e a importância e o papel das pretensões de direito na avaliação normativa da ação polÃtica. O argumento é o de que esse esforço de esclarecimento é necessário à utilização eficaz da linguagem dos direitos. E oferece recursos suficientes para rejeitar três tipos de objeção muitas vezes feitas à noção de direitos humanos: a de que não é universalizável; a de individualismo moral; e a que sustenta que a avaliação da ação polÃtica, de teor conseqüencial, não comporta o recurso a princÃpios, tais como esses direitos acima de tudo são.

Abstract in English:

What do we mean when we say that a person A has a right to X? The article discusses this question by outlining an account of the foundations of rights and of the significance and role of right claims in the normative evaluation of political action. The effectiveness of the language of rights, it is argued, depends on the availability of such an account. Moreover, it also allows to meet three major objections to the concept of Human Rights: its non universality; its moral individualism; and that of the act-consequencialist view according to which in evaluating political action no room is left to moral rules such as Human Rights.

Busca-se avaliar a eficácia do direito econômico e social num Estado como o brasileiro. Conclui-se que a baixa eficácia revela a crise estrutural de um Estado nacional cujas instituições não lograram compatibilizar ordem legal e justiça material, certeza jurÃdica e reformas sociais, estabilização macro-econômica e legitimação democrática.

The author argues that economic and social law lacks effectiveness in Brazil. For him this is due to the structural crisis of a national State unable to match legal order with material justice, judicial certainty with social reforms, macroeconomic stabilization with democratic legitimation.

Perante os desafios globais com que se defronta a Humanidade no seu conjunto, o Direito Internacional é atravessado por um processo de transfiguração de alguns de seus postulados clássicos. In the presence of the global challenges confronting humanity, International Law is traversed by a process of transformation of some of its classic postulates. After summing up the main lines of this change, the greatest symbol of which is the international regime of the common heritage of humanity, this article questions the adequacy of current accentuations of the institutional dimension in this process to the structure of contemporary international society.

Examina-se, da perspectiva das organizações não-governamentais, como devem ser consideradas as diversas formas de violência que têm impacto sobre os direitos humanos na América Latina, com destaque para a violência estatal e paraestatal, das guerrilhas, do narcotráfico e da criminalidade comum. O autor argumenta que a idéia da violação dos direitos humanos deve ser reservada à ação de agentes públicos. Violências praticadas por agentes não estatais devem ser vistas sob uma ótica distinta.

The question of how to take account of the various forms of violence with an impact on human rights in Latin America is asked from the standpoint of non-governmental organizations. The author argues that the idea of violation of human rights should be restricted to the action of public agents. Violence inflicted by non-state agents should be viewed from a different angle.

Defendendo ser a saúde uma dimensão relevante para a reflexão ética, pois que afeta a própria vida, o autor advoga o direito à saúde opondo-se a concepções para as quais a demanda por saúde deve ser resolvida pelo mercado. Conjuga sua defesa a uma análise dos óbices existentes à realização de tal direito (dentre eles a mercantilização da medicina) e à indicação de alternativas éticas e práticas.

Arguing that health, since it is of importance to life itself, is a relevant aspect of ethical judgement, the author makes out a case for a right to health while rejecting market-based accounts of medical care. The hindrances to the achievement of such right, above all the profit-aimed outlook of medicine, are discussed, and ethical ways of dealing with questions of health are pointed out.

Populismo e violência, racismo e xenofobia aparecem como a contrapartida de um processo acelerado de modernização que desafia a capacidade de integração social européia. The dark side of the European unification is discussed. Populism and violence, racism and xenophobia appear as a counterpart to an accelerated process of modernization that defies Europe's capability for integration. The different ways of facing this problem in France and Germany are examined.

O autor interpreta o pensamento de Tocqueville à luz dessa questão, trabalhando com o conceito de americanismo - isto é, a conciliação que se tornou possÃvel nos Estados Unidos, sem que rupturas revolucionárias ocorressem, entre estado social de igualdade e liberdade, entre interesse e virtude, entre privado e público. É essa conciliação, argumenta o autor, que Tocqueville, atento para a irresistÃvel igualização das condições de vida na Europa, viu na experiência norte-americana.

Who should learn from whom: America or Europe? The author interprets Tocqueville's thought in the light of this question, working with the concept of 'Americanism' - to wit, the bringing together of the social state of equality and of liberty, of interest and of virtue, of private and public life, that took place in America without revolucionary rupture. It was this that Tocqueville, with an eye on the European experience of irresistible equalization of life conditions, saw in the American experience.
