Traditional black communities and the protection of the ILO Convention 169

Abstract

The article proposes to conduct a study on the ILO Convention 169 of 1989 in the brazilian context, questioning whether those with african roots terreiro communities are supported under his tutelage. As a result, it was necessary to assert the term “tribal people”, contained therein, is updated before the subsequent laws that defend cultural diversity and the protection of social minorities. Thus, it runs through the debate on the self-identification of the loaded mechanism that Convention and the history of the legislation that succeeded it from the standpoint of the necessary protection of individual and group identity. At the end of this text, it is concluded that it is fully justified the framework of communities of African origin terreiros under the cloak of protection of Convention 169 of the ILO.
