Com o presente artigo, pretende-se analisar se nessa disputa de forma de construção constitucional havia também um enfrentamento sobre a passagem do tempo e seu controle. Será realizada uma investigação teórica sobre o processo histórico da construção constitucional de 1987 e do uso das formulações críticas sobre a relação entre direito e política na categoria do poder constituinte.Resumo em Inglês:
Abstract The congressional form of the constituent of 1987 was not a consensus among the oppositionists of the dying regime and the pro-regime. This paper tries to analyze if in this dispute of form of constitutional construction there was also a confrontation on the passage of time and its control. Resumo O artigo objetiva explanar de que forma o rock pode ser visto como um elemento capaz de dar voz a demandas de sujeitos marginalizados. Tendo por foco o genocídio armênio, procurou-se demonstrar como a atuação da banda System of a Down contribui para que o assunto ganhe visibilidade. Abstract The article aims to explain how rock can be seen as an element capable of giving voice to the demands of marginalized subjects. Focusing on the Armenian genocide, we sought to demonstrate how the performance of the band System of a Down contributes to the issue gaining visibility. Thus, the documentary Screamers, which emphasizes the reception of the public about the Armenian genocide, was used as the main source of research.Resumo em Português:
Resumo O presente trabalho tem como objetivo principal oferecer ao leitor a apresentação de uma nova perspectiva dentro dos estudos jurídicos comparados. A aqui denominada “Filosofia do direito comparado” ou “perspectiva cultural do direito comparado” se apresenta como um poderoso arcabouço intelectual interdisciplinar que proporciona as indagações necessárias para a realização de reflexões epistemológicas no campo do direito comparado. Essas reflexões, mais do que contribuírem para um refinamento da produção da dogmática jurídica comparada, revigoram o debate em torno da comparação jurídica e reverberam a importância do próprio campo para o estudo do direito interno, reafirmando a importância dos estudos comparados para a ciência jurídica.Resumo em Inglês:
Abstract This paper aims to provide the reader a new perspective in legal comparative studies. The so-called “philosophy of comparative law” or “cultural approach of comparative law” presents itself as a powerful interdisciplinary intellectual framework that provides the necessary inquiries for the realization of epistemological reflections in the field of comparative law. These reflections, rather than contributing to a refinement of the production of comparative legal studies, reinvigorate the debate around legal comparison and reverberant the importance of the field itself for the study of domestic law, reaffirming the importance of comparative studies for legal science.Resumo em Português:
Resumo O artigo propõe a reflexão acerca da participação do Poder Judiciário na (re)produção da segregação socioespacial urbana no Brasil. Para tanto, realizou-se pesquisa empírica com a coleta e análise de decisões sobre conflitos fundiários urbanos de natureza coletiva. As fontes coletadas compreendem decisões proferidas em Tribunais de Justiça das cinco regiões brasileiras no período entre 2014-2015. Incluíram-se também as decisões proferidas pelo Superior Tribunal de Justiça e pelo Supremo Tribunal Federal entre os anos de 2002 e 2015. Das ementas analisadas foram selecionadas 311 decisões, com sistematização do conteúdo subjacente às respectivas fundamentações que autorizam as remoções forçadas. Os resultados obtidos na análise qualitativa são apresentados no presente trabalho e permitem vislumbrar a compreensão do Judiciário brasileiro acerca das relações entre direitos, espacialidades e subjetividades nas cidades.Resumo em Inglês:
Abstract The article proposes the reflection on the participation of the Judiciary in the (re) production of urban socio-spatial segregation in Brazil. For that, an empirical research was conducted with the collection and analysis of decisions on urban land conflicts of a collective nature. The collected sources comprise decisions rendered in Courts of Justice of the five Brazilian regions in the period between 2014-2015. The decisions pronounced by the Superior Court of Justice and the Federal Supreme Court between the years of 2002 and 2015 were also included. Of the analyzed articles, 311 decisions were selected, systematizing the content underlying the respective grounds that authorize the forced removals. The results obtained in the qualitative analysis are presented in the present work and allow to glimpse the understanding of the Brazilian Judiciary about the relations between rights, spatiality and subjectivities in the cities.Resumo em Português:
Resumo O artigo analisa inicialmente a ambiguidade do processo de anistia e redemocratização do Brasil. Em seguida, o foco é o papel do judiciário tanto na judicialização da repressão durante a ditadura quanto no processo de anistia. Na terceira seção é fornecida uma breve caracterização da ruptura institucional ocorrida no Brasil em 2016 e uma discussão sobre a natureza dessa ruptura. Abstract The article initially analyzes the ambiguity of the amnesty and redemocratization process in Brazil. Next, the focus is on the role of the judiciary in both the judicialization of repression during the dictatorship and in the amnesty process. In the third section is provided a brief characterization of the institutional rupture occurred in Brazil in 2016 and a discussion about the nature of this rupture. Finally, in a concluding tone, we identify relationships between the mentioned processes.Resumo em Português:
Resumo No mundo contemporâneo houve um enfraquecimento das utopias modernas, com isso uma relativização de certos valores e mesmo de algumas bandeiras morais da modernidade. Ao mesmo tempo, aconteceu uma drástica mudança nos padrões de socialidade, com o declínio das instituições tradicionais e fortalecimento das relações gregárias de natureza comunitária. Isso abre espaço para um repensar do sentido e do papel da ética. A ética deve ser entendida, então, a partir da relação com o outro. Propõe a ideia de ética da alteridade, por propiciar que o outro exista como potência, como força que pode construir-se a si mesma. Aqui reside o sentido mais profundo da ideia de emancipação. Também propõe como tarefa especial da ética a consideração pelo sujeito da injustiça social, de forma a contribuir com as condições de possibilidade de autoemancipação do oprimido.Resumo em Inglês:
Abstract In the contemporary world there has been a weakening of modern utopias, with a relativization of certain values and even some moral flags of modernity. At the same time, there has been a drastic change in patterns of sociality, with the decline of traditional institutions and the strengthening of community-based gregarious relations. This opens space for a rethinking of the meaning and role of ethics. Ethics should be understood, then, from the relationship with the other. It proposes the idea of ethics of otherness, by providing that the other exists as a potentiality, as a force that can build itself. Herein lies the deeper meaning of the idea of emancipation. It also proposes as a special task of ethics the consideration by the subject of social injustice, in order to contribute to the conditions of possibility of self-emancipation of the oppressed.Resumo em Português:
Resumo Este estudo analisa a obra “O oráculo de Delfos: o Conselho de Estado no Brasil-Império”, de José Reinaldo de Lima Lopes. Num primeiro momento, expõe a reconstrução analítica dos principais argumentos do autor, de forma a destacar suas contribuições à história do direito brasileiro. Analisa, depois, os pontos em que a obra deixa a desejar na compreensão da monarquia constitucional brasileira. Com base em fontes históricas, conclui inaugurar O oráculo de Delfos uma senda para novas pesquisas, que, por sua vez, precisam estar mais atentas à teoria constitucional do século XIX, à discussão pública como fonte histórica e à sobreposição do Executivo ao Legislativo em fins do citado século.Resumo em Inglês:
Abstract This study analyzes the work “The Oracle of Delphi: the Council of State in Imperial Brazil”, by José Reinaldo de Lima Lopes. At first, it expounds an analytical reconstruction of the author’s main arguments, in order to highlight his contributions to the history of Brazilian law. It analyzes, thereafter, the points in which the work lacks of a deeper understanding of Brazilian constitutional monarchy. Based on historical sources, it infers that the Oracle of Delphi establishes a pathway for further research, which in turn should to be more attentive to 19th century constitutional theory, to public discussion as historical source and to the overlap of the executive and legislative branches at the end of the 19th century.Resumo em Espanhol:
Resumen En América Latina los procesos políticos por el reconocimiento de los derechos sexuales y reproductivos han generado una serie de disputas entre sectores antagónicos. Por un lado, los movimientos feministas y LGBTTI pugnan por la inclusión y ampliación de estos derechos en las políticas públicas. Frente a ellos, se viene consolidando un activismo de oposición cada vez más complejo que trasciende a los actores religiosos que históricamente han defendido una moral sexual conservadora. Desde la sociedad civil, se han conformado una serie de ONG que privilegian la judicialización y el uso de un lenguaje de derechos humanos como estrategias de impacto político y social. Este trabajo identifica y analiza la configuración y evolución de las ONG católicas “Pro-Vida” de cohorte católico en Argentina en su accionar frente a las Cortes.Resumo em Inglês:
Abstract In Latin America, a political process for the recognition of sexual and reproductive rights has generated a series of disputes between opposing sectors. On one hand, feminist and LGBTTI movements struggle for the inclusion and broadening of these rights in public policies. On the other hand, a more complex opposition activism is consolidating, that transcends the religious actors that have historically defended conservative sexual morals. From civil society, a series of Catholic NGOs have been formed that privilege legal strategies and the use of human rights language as strategies for political and social impact. This paper identifies and analyzes the configuration and evolution of the Catholic self-proclaimed “pro-life” NGOs in Argentina and their concrete actions before the courts.Resumo em Português:
Resumo Partindo do reconhecimento de que a governança corporativa tornou-se uma tecnologia dominante para disciplinar conflitos corporativos, este trabalho avalia sua extensão para o ambiente empresarial das companhias estatais de economia mista. O artigo discute, a partir de estudos de caso, os dilemas singulares destas empresas. Os casos analisados são a Sabesp, diante da crise hídrica de São Paulo, e a Eletrobrás, em vista da revisão das concessões do setor elétrico. O estudo dos casos permite entender em concreto o conflito de interesses apresentado pela literatura jurídica de forma hipotética. Com base nisso, o artigo apresenta uma tipologia dos conflitos que se aplica a estes casos e casos similares.Resumo em Inglês:
Abstract Recognizing that corporate governance currently dominates the debate over conflicts of interest in companies, this paper evaluates how the corporate governance debate extends to mixed corporations. The paper undertakes case studies to appraise state-owned companies’ particular dilemmas. Cases studied were the water crisis faced by Sabesp and the renegotiation of public concessions held by the Federal Government through Eletrobras. The cases suggest how the corporate governance of mixed corporations works in action, compared to the hypotheses of the literature. Then, we use our findings to propose a typology of conflicts to explain these cases and other conflicts which may arise in similar state-owned corporations.Resumo em Português:

Abstract This article is the product of immanent reading accomplished in part of the Ontology of Social Being, in which Györg Lukács exposes the main universal historical tendencies from which the social being reproduces itself. By clarifying as how the man makes his own history, even if in circumstances not desired by him, the author demonstrates the ontological possibility of the end of the exploration of men by men. Abstract This article seeks to gather observations on the epistemological and methodological production developed by Michael Burawoy, a Marxist sociologist and professor at the University of Berkeley. Five moments of analysis are presented, which explore the opposition between the reflexive model of science and positive science, the method of the extended case study, his analysis of the disciplinary field of American sociology, the responses to criticisms extracted from Becker and Lakatos and their understanding of the social structure as opposed to structuralist functionalism.Resumo em Português:

Abstract From the celebration of Marx's 200th birthday, this research aims to analyze the transformation of the juridical alienation phenomenon in Marx's theoretical laboratory, Grundrisse . Based on the reading of the first major essay “The Capital”, where Marx makes his great discoveries in the context of his critique of political economy, we seek to evaluate the itinerary and the unfolding of the alienation theme along with the development of his theory of value. In the end, we also address the constituent function of law as mediator of the capital temporality from the mechanisms of (non)-equivalence formation.Resumo em Português:

Abstract This article presents some initial contributions on (re) thinking the centrality of the agrarian question in the histories and struggles of Latin America past and present, from a Marxian and Marxist referential. Three moments will be worked out, namely: 1) Abya Yala x Latin America; 2) Latin America and dependent capitalist state; 3) Latin America and the various phases of the ideology of development. The main objective is to reinforce how the agrarian question has always been at the heart of the social function of Latin America and the Caribbean in the general dynamics of capital production and reproduction, even in times of contemporary discussions about the general problems of the peripheral landscapes of the 21st century. Abstract From questions debated during a “Forum Marx”, organized by the newspaper L’Humanité, and with a dialectic and interdisciplinary approach, this article intends to delineate an answer to the question introduced by its title, coming back on few arguments of those “blaming” Marx as for over-emphasizing on high productivity and those defending a “ecologist Marx”. In a second part, the intention is to propose interwoven considerations about the actuality of the Marx’s theoretical legacy, even 200 years after his birthdate, as a support for the analysis and understanding of the environmental issue, the socioenvironmental consequences of production and consumption modes, with a background of a capitalism entering in crisis.Resumo em Português:
Resumo: O artigo introduz uma interpretação da acumulação primitiva contínua com foco em sua dimensão ideológica. A tese principal do trabalho é que a dimensão ideológica da acumulação primitiva é necessária para analisar a) a obtenção do consentimento social em processos de acumulação primitiva como um processo sem alternativa; b) entender os processos da acumulação primitiva contínua também no nível cultural e simbólico para poder intervir politicamente em novas áreas valorizadas economicamente; e c) conectar este conceito marxista com perspectivas des- ou pós-coloniais. A fim de demonstrar o exposto, primeiramente, a leitura mais comum da “assim chamada acumulação primitiva” é esboçada com foco na dimensão crítica-ideológica, que, como será mostrado, já fora pensada no texto original de Marx. No segundo passo, essa dimensão crítica-ideológica de Marx é conectada com as reflexões críticas-ideológicas de Stuart Hall. Abstract: The paper presents an interpretation on continuous primitive accumulation with regards to its ideological dimension. The work´s main thesis is that the ideological dimension of primitive accumulation is necessary to analyze a) the obtaining of social consent in primitive accumulation processes as a process without alternative; b) to understand the processes also at the symbolic and cultural level, in order to intervene politically in new areas economically valuated; c) to connect this Marxist concept with de- or post-colonial perspectives. In order to demonstrate the aforementioned, firstly, the most common reading on “so called primitive accumulation” is outlined with a focus on the ideological-critical dimension, which, as will be presented, has already been considered in Marx’s original text. Secondly, this ideological-critical dimension by Marx is connected with Stuart Hall’s ideological-critical reflections. Following a brief summary of a heuristic conception of continuous primitive accumulation, some starting points are shown for the connection between the analysis of current processes of continuous primitive accumulation and de- and post-colonial perspectives.Resumo em Português:

Resumo Dentre as inúmeras incompreensões sobre a obra marxiana e a teoria vinculada ao campo marxista está a ideia de que o indivíduo não é abordado. Ao voltar-se às grandes narrativas, ao funcionamento do modo de produção capitalista, às classes sociais e ao ideário de revolução social, estaria o marxismo subestimando – ou mesmo ignorando – as subjetividades. Perante esta controvérsia histórica, este artigo buscará apontar pistas para a compreensão do indivíduo em Marx e no campo marxista, reposicionando o diálogo entre marxismo e psicologia. Abstract Among the innumerable misunderstandings about the Marxian work and the theory linked to the Marxist field is the idea that the individual is not present. By turning to the great narratives, to the functioning of the capitalist mode of production, to social classes and to the ideology of social revolution, Marxism would be underestimating - or even ignoring - subjectivities. Given this historical controversy, this article will seek to point out clues to the understanding of the individual in Marx and in the Marxist field, repositioning the dialogue between Marxism and psychology. To revisit the ontology of the social being and the work category, they are indispensable.Resumo em Português:
Resumo O artigo apresenta a interpretação construída pela Filosofia da Libertação de Enrique Dussel sobre os principais aspectos da subsunção (e superação dialética) da filosofia hegeliana pelo materialismo histórico de Marx. Abstract The article presents the interpretation constructed by Enrique Dussel’s Philosophy of Liberation on the main aspects of the subsumption (and dialectical superation) of hegelian philosophy by Marx's historical materialism. It identifies two significant phases of fundamental rupture, the first started in october of 1843, and the second represented by the theoretical “turn” configured by the so-called “last Marx”.Resumo em Português:
Resumo O texto tem por objetivo principal mostrar a influência de pensamento de Marx na filosofia da libertação de Enrique Dussel. No desdobramento do objetivo indicado, destaca-se como a partir de categorias marxistas, Dussel especialmente no livro Grundrisse de Marx, confirma e desenvolve com novos argumentos as suas intuições filosóficas iniciais das décadas de 1960 e 1970. Abstract The main objective of the text is to show the influence of Marx's thought on the philosophy of liberation of Enrique Dussel. In the unfolding of the indicated objective, it is highlighted as from Marxist categories, Dussel especially in the book Grundrisse of Marx, confirms and develops with new arguments his initial philosophical intuitions of the 1960s and 1970s. Finally, to conclude that the philosophy of liberation, without abandoning Marx, is projected beyond him.Resumo em Português:
Resumo Neste ensaio, analiso diferentes formas como relações de gênero e de sexualidade operam na tessitura narrativa do julgamento do Habeas Corpus 152752/PR, impetrado pelos advogados de Luiz Inácio Lula da Silva junto ao Supremo Tribunal Federal. Para tanto, examino os votos dos três ministros do Supremo que aludiram às figuras do “estupro” e/ou do “estuprador” durante as fundamentações de suas decisões. Com isso, persigo duas tematizações principais: a) a de que a mobilização de convenções morais de gênero e de sexualidade participa profundamente das narrativas judiciais e, em especial, da figuração do “algoz”, de modo que o “estuprador” acaba funcionando como exterior constitutivo do “réu”; e b) a de que relações de gênero e de sexualidade atuam na produção de sentidos, lógicas e processos de Estado, mas sobretudo, no que aqui interessa mais diretamente, em suas dimensões jurídicas.Resumo em Inglês:
Abstract On this essay, I analyze different ways in which gender and sexuality relations works on the narrative contexture of the judgement of the Habeas Corpus 152752/PR, impetrated by Luiz Inácio Lula da Silva's lawyers to the Brazilian Federal Supreme Court. Therefore, I examine the three Federal Supreme Court ministers' votes in which the figures of “rape” and/or “rapists” were alluded on the basis of their decisions. Thereby I pursue two main problems: a) the mobilization of moral conventions about gender and sexuality deeply participates in the juridical narratives and, specially, in the figuration of the “executioner”, in a way that the “rapist” works as an external element which constitutes the “defendant”; and b) gender and sexuality relations act on the production of Estate's meanings, logics and processes, but, overall, on what interests here the most, act on the juridical dimensions.
