Abstract: The article discusses the youth offenders' right to religious assistance. From the identification of many forms of violation of this right in socio-educational system of Rio de Janeiro, it was organized a survey of the actors in the judicial system, namely: judges, advocates, prosecutors and a representative of the State Board of Children and Youth Rights. The focus of the research was to identify the concept of religious assistance from these actors and if they acknowledge the legislation. The survey was conducted in 2010 and demonstrated that members of the judiciary are unprepared to deal with the right of religious assistance from youth offenders.
