The judicialization of the Continued Benefit Payments (BPC) from provision of social assistance

This article is based on the legalization of the Continued Benefit Payments (BPC), developed through an empirical analysis in a database about the benefit. The study examined the relevance of the judiciary in ensuring the constitutional rights, and the important role played during the BPC, however, it identified the strengthening of inequality by judiciary, unequal access through to their bodies in large Brazilian regions and pointed out the need for enhancement of the judiciary functions in favor of actions for the strengthening of citizenship and the realization of social rights.
