The Advent And Creation Of Urbanistic Plans And Urbanistic (In)Equality In Brazil: Realities, Developments And Legal And Social Consequences After Decades And Years Of The Arrival Of The Constitution And Other Iconic Urban Legislation

ABSTRACT

This legal article, based on the analysis of a relationship between the principle of equality and Urbanistic Law, first examines equality itself as the foundation of the Brazilian legal system, and then proceeds to convergence with issues of an urban nature. More precisely, it will seek to link equality and its antithesis, inequality, with the figures of the master plan and integrated urban development plan (PDUI - initials in Portuguese), in the search for confirmation of the hypothesis of the existence of constitutionally unjustified inequalities, in which it touches on the most varied urban relations, even after more than twenty years since the arrival of the City Statute to Brazilian Law, as well as decades of the Republican Constitution and years of the Metropolis Statute. The analytical-deductive method commands an article in which examples are used, in addition to collecting data and information directly from official and governmental sources. The demonstration that urban inequalities are a reality in the main Brazilian capitals and urban centers will permeate, mediately and immediately, this text and be its biggest goal. And all this to conclude for the massive presence of urban inequalities in Brazilian cities and the need to fortify the figure of urban plans in the country, without which any developmental pretensions and fundamental constitutional norms will find support for a real and evolutionary implementation.
