Could the law be decolonial?

Abstract

This paper aims at discussing the theoretical and conceptual shortcomings in Boaventura Santos' work from his linking to the Modernity/Coloniality Group, especially with regard to the law. To do so, it first presents, in general terms, the history of that group and its fundamental features. After that, it debates the similarities as well as possible divergences between B. Santos' conceptions and the decolonial thinking, even before their official linking. Next, it approaches the main theoretical and conceptual developments in the work of Boaventura Santos from his linking to the decolonial thinking. Finally, the aforementioned theoretical and conceptual shortcomings are directly adressed.
