Neste artigo comento algumas dificuldades relativas à produção do conhecimento sobre tráfico de pessoas. Tomo como referência experiências de pesquisa realizadas no Brasil e na Espanha que mostram a importância de mapear e situar os pressupostos dos diferentes grupos de interesse envolvidos, incluindo as pessoas que se espera proteger e atender. Analiso problemas metodológicos, discutindo os efeitos da vigência de diferentes definições de tráfico de pessoas na produção de dados e documentos. Finalmente, levo em conta a contribuição das distinções entre crime e violação dos direitos humanos para refletir sobre um dos aspectos presentes no material: a distância entre a percepção de pessoas tecnicamente consideradas vítimas de tráfico e definições legais desse crime.

In this article, I comment on some difficulties related to the building up of knowledge on human trafficking. I base myself on research experience carried out in Brazil and in Spain which shows the importance of mapping and locating the notions of the different interest groups involved, including those people whom it is expected to protect and help. I analyze methodological problems, discussing the effects of the validity of the different definitions of human trafficking in the production of data and documents. In conclusion, I take into consideration the distinctions between crime and the violation of human rights so as to reflect on one of the aspects present in the material: the distance between the perception of tose technically considered to be victims of trafficking and the legal definitions of this crime.

O cerne do conceito de tráfico de pessoas, estabelecido no Protocolo de Palermo, apóia-se na noção de exploração. Visando contribuir ao esclarecimento dessa noção, o texto propõe uma abordagem do tráfico de pessoas como uma questão do mundo do trabalho e utiliza o conceito de trabalho forçado, cunhado em convenções da Organização Internacional do Trabalho (OIT), sempre considerando sua interface com as dimensões de gênero e com aspectos de oferta e demanda de mão-de-obra que orientam os fluxos migratórios

The core of the concept of trafficking in persons, defined in the Palermo Protocol, is based on the notion of exploitation. This text approaches trafficking in persons as a labor issue with a view to helping clarify this notion. The forced labor concept, formulated by the International Labor Organization, supports this discussion. This concept is considered in its dialog with gender dimensions and with the supply-demand aspects that steer migratory movements.

O conteúdo de 23 decisões judiciais proferidas no período de 2004 a 2008, em casos de tráfico de mulheres para a prostituição (art. 231 do Código Penal) é analisado no contexto teórico da Criminologia Crítica feminista com o objetivo de verificar se os juízes avaliam o fato na perspectiva de gênero, de maneira a não reforçar a discriminação e a violência contra as mulheres. A análise revela posições ambíguas entre o respeito à liberdade sexual/dignidade humana e a proteção da moralidade pública, bem como a sobrevitimização das mulheres, o que torna duvidosa a eficácia da aplicação da lei penal na prevenção do tráfico.

The content of 23 judicial decisions reached between 2004 and 2008, in cases of trafficking women for prostitution (article 231 of the Penal Code) is analysed in the theoretical context of the Feminist Critical Criminology to verify if the judges evaluate the facts in the gender perspective, so that the discrimination and violence against women is not reinforced. The analysis reveals ambiguous positions between respect for sexual freedom/ human dignity and the protection of public morality, as well the overvictimization of women, which calls into question the effectiveness of the penal law enforcement in the prevention of trafficking.

Com base no inteiro teor de sentenças condenatórias de tráfico de pessoas no Brasil, concedidas entre 2003 e o início de 2008, com base nos artigos 231 e 231-A do Código Penal, o artigo analisa o tratamento dado pelo Sistema de Justiça ao tema. A análise busca comparar o conceito internacional, consagrado na definição dada pelo Protocolo Adicional à Convenção das Nações Unidas contra o Crime Organizado Transnacional relativo à Prevenção, Repressão e Punição do Tráfico de Pessoas, em especial Mulheres e crianças, mais conhecido como Protocolo de Palermo, à idéia contida na normativa nacional. O objetivo maior da análise é buscar responder se é possível transformar grandes temas de Direitos Humanos em políticas públicas que efetivamente respondam aos interesses daqueles que pretendem proteger.

Based on the full text of condemnatory sentences for human trafficking, issued by Brazilian courts between 2003 and the beginning of 2008, for articles 231 and 231-A of the national Penal Code, the article analyzes how the theme is seen by the Justice System. The analysis strives to compare the international concept contained in the definition of the United Nations Additional Protocol to the Convention Against Transnational Organized Crime to Prevent, Supress and Punish Human Trafficking, specially of women and children, better known as the Palermo Protocol, with the ideas contained in the national law. The greater objective of the analysis is to answer if it is possible to transform great themes of Human Rights into public policy that effectively responds to the interest of those groups they aim to protect.

A Criminologia Positivista no Brasil contribuiu para a criação e fortalecimento de estereótipos que influenciam as relações sociais atuais. A Criminologia, enquanto ciência, fortaleceu a idéia do que se chamou "ideal feminino", ou seja, comportamentos padrões que seriam "naturais" e esperados para as mulheres. Um dos temas que mais chamavam a atenção era a sexualidade, o que criou padrões rigídos e preconceitos que perduram até os dias atuais. Esse é um dos motivos que faz com que as mulheres, hoje, vítimas do tráfico para fins de exploração sexual sejam vistas como agressoras e não sejam merecedoras de um tratamento digno e adequado.

The Positivist Criminology in Brazil, contributed to the creation and strengthening of stereotypes that influence recent social relations. Criminology, as a science, strengthened the idea called "feminine ideal", being, standard behaviors, considered "natural" and expected to women. One of the issues that drew most attention was sexuality, which created rough standards and prejudices that persists until nowadays. This is a reason for the women today, victims of trafficking in persons for sexual exploitation means, to be seen as aggressors and not worthy of a dignified and appropriate treatment.

O texto estimula a discussão e a reflexão sobre outros aspectos que envolvem a escravidão contemporânea no Brasil: o processo de construção da masculinidade que permeia a partida dos jovens trabalhadores rurais que acabam enredados no endividamento progressivo e, paralelo a este, o processo de desenraizamento social, que apaga os laços com a família deixada para trás e com os lugares de origem desses jovens trabalhadores. Isso acentua sua vulnerabilidade e contribui para que suas vidas sejam destituídas de valor político e importância social.

The text stimulates a reflection and discussion about other aspects concerning contemporary slavery in Brazil: the process of constructing masculinity carried out by young male rural workers who leave their family home to search for work and run into debt, together with the process of social uprooting that eliminates links with the family left behind and with the place of origin of these young men. Those processes increase their vulnerability and contribute to making their lives devoid of political value and social importance.

Este artigo busca contextualizar, em linhas gerais, o fluxo de imigrantes bolivianos para fins de trabalho nas oficinas de costura da cidade de São Paulo, demonstrando a interface dessa imigração com o tráfico de migrantes e o tráfico de pessoas. Por meio de depoimentos, são apresentadas as recorrentes dificuldades enfrentadas pelas trabalhadoras imigrantes.

This article seeks to contextualize, along general lines, the Bolivian migratory flow towards sweatshops in the city of São Paulo, showing the interaction between this migratory flow, migrant smuggling and human trafficking. The most frequent problems faced by the migrant women are presented in testimonials.

Este artigo discute as experiências de homens e mulheres brasileiros, que tentam cruzar a fronteira México-Estados Unidos em viagens não-autorizadas no mundo global. São viajantes clandestinos que, com a ajuda dos coiotes, tentam entrar na "América". Na produção sobre tráfico de pessoas e "contrabando" ou tráfico de migrantes (smuggling), as questões relativas a gênero tendem a ser tratadas considerando-se que os homens brasileiros estão predominantemente vinculados ao tráfico de migrantes, enquanto as mulheres são vítimas de tráfico de pessoas para exploração sexual. Neste texto mostro que homens e mulheres estão envolvidos no tráfico de migrantes e ambos enfrentam os riscos, a aventura ou desventura de cruzar a fronteira ou de ser deportado.

This article discusses the experiences of Brazilian men and women who try to cross the México-United States border in non-authorized trips in the global world. They are illegal travelers who, with the coyotes' help (immigrant smugglers), try to get into "America". In the literature, questions concerning gender tend to be treated by taking for granted that the Brazilian men are predominantly linked to migrant smuggling, while the women are victims of trafficking for sexual exploitation. The aim of this text is to demonstrate that both men and women are involved in migrant smuggling and both face the risks, the fortune or misfortune of crossing the border or being deported.

Este texto apresenta algumas observações sobre as violações de direitos humanos que têm lugar na migração internacional e no tráfico de pessoas a partir dos relatos de mulheres migrantes abordadas pela equipe do Posto de Atendimento Humanizado aos/às Migrantes, no aeroporto internacional de Guarulhos. A apresentação desses casos mostra a violação de direitos nesse contexto e a importância de se discutir o enfrentamento ao Tráfico de Pessoas a partir de uma perspectiva de gênero e Direitos Humanos.

This paper presents some comments about violations of human rights taking place in international migration and human trafficking from the reports of migrant women gathered by the team of the Posto de Atendimento Humanizado aos/às Migrantes, in the International Airport of Guarulhos. The presentation of these cases shows the violation of rights in that context and the importance of discussing the confrontation with Trafficking in Persons from a perspective of gender and Human Rights.

O sonho do deslocamento entre Brasil-Europa pode ser encontrado de forma recorrente na bibliografia sobre a temática travesti. As modificações relativas ao tráfico de pessoas realizadas no Código Penal brasileiro, em 2005, possibilitam diversas interpretações para os termos facilitar e facilitação, criminalizando ações que, para este grupo, se constituíam, até então, como formas de sociabilidades. Argumento que o não reconhecimento da prostituição como um trabalho distancia essas travestis de outras brasileiras que trabalham indocumentadas, potencializando o envolvimento destas em situações de vulnerabilidade.

The dream of traveling between Brazil and Europe is easy to find in the referential bibliography about transvestites. The changes related to the trafficking in persons, in the Brazilian penal code in 2005, show how different interpretations of the terminology "facilitate" and "facilitation" made a strong impact on transvestites' lives, criminalizing some practices of this group that had in fact been part of their sociability. I argue that the unrecognized position of prostitution as legal work creates a substantial gap between the transvestites and the other illegal Brazilian workers, which leads them into potentially vulnerable situations.

Feministas e outros acadêmicos vêm debatendo teoricamente o que exatamente é comprado numa transação de prostituição e se o sexo pode ser "um serviço como qualquer outro", mas raramente lidaram empiricamente com essas questões. Este artigo se baseia em observações de campo e entrevistas com clientes masculinos de trabalhadoras do sexo comercial e com agentes do Estado encarregados de regulá-las para investigar os significados dados a diferentes tipos de trocas sexuais comerciais. Manifestados por detenção e re-educação de clientes, apreensão de veículos, leis mais estritas sobre a prostituição de menores e a posse de pornografia com crianças, recentes esforços do Estado para problematizar a sexualidade masculina em todos os EUA e Europa Ocidental se desenvolveram ao lado de uma ética de consumo sexual descontrolada, evidenciada pela imensa demanda por pornografia, clubes de strip-tease, "lap-dancing"¹, acompanhantes, sexo por telefone e "turismo sexual" em países em desenvolvimento. Ao situar a troca sexual comercial dentro do contexto mais amplo das transformações pósindustriais da cultura e da sexualidade, podemos começar a desvendar esse paradoxo.

Feminists and other scholars have debated theoretically what exactly is being purchased in the prostitution transaction and whether sex can be "a service like any other", but they have scarcely tackled these questions empirically. This article draws upon field observations of and interviews with male clients of commercial sex-workers and state agents entrusted with regulating them to probe the meanings given to different types of commercial sexual exchange. Manifested by client arrests and re-education, vehicle impoundment, stricter laws on underage prostitution and the possession of child pornography, recent state efforts to problematize male sexuality throughout the USA and Western Europe have been developed alongside an increasingly unbridled ethic of sexual consumption, as evidenced by soaring demand for pornography, strip clubs, lap-dancing, escorts, telephone sex and "sex tours" in developing countries. By situating commercial sexual exchange within the broader context of post-industrial transformations of culture and sexuality, we can begin to unravel this paradox.

Uma das estratégias de controle usadas pelos grupos armados no marco da agudização do conflito na Colômbia é o controle e a "gerência" da prostituição (e da sexualidade em geral) nos territórios de dominação. O que significa ser prostituta no contexto de controle armado masculino na Colômbia contemporânea? Quais as possibilidades da vivência dos direitos humanos nas mulheres trabalhadoras sexuais nesse contexto? Essas perguntas surgem da vivência próxima da história da Lady entre os anos 2003 e 2005, e levam, a partir do trabalho de campo realizado em 2007 no município de Puerto Berrío (Colômbia), a uma reconstrução etnográfica do significado da prostituição num contexto de dominação masculina paramilitar. O tráfico de mulheres apresenta-se como o lado feminino do recrutamento e, mesmo que seja relativamente voluntário, termina se configurando numa dinâmica de retenção-punição com altíssimos custos para a experiência feminina.

One of the control strategies used by armed groups as the conflict worsens in Colombia is the control and "management" of prostitution (sexuality in general) in the territories under domination. A sex industry, characterized by violence, fear, manipulation and restricted options, is produced in this situation. What does it means to be a prostitute in the context of armed control in contemporary Colombia? What possibilities do these female sex workers have to exercise their human rights in this context? These questions first arose through our close contact with Lady, "comadre" and friend, between 2003 and 2005. Subsequent field work was conducted in 2007 in Puerto Berrío (central Colombia), aiming at the ethnographic reconstruction of the meaning of prostitution within a paramilitary context of male domination in contemporary Colombia. The traffic of women is shown to be the female part of the recruitment; although the process may be considered relatively voluntary, the final configuration is one of retention-punishment with high costs for the female experience.

A literatura obscena produzida no último quarto de século no país mobiliza um repertório de fantasias próprio da sensibilidade urbana do Brasil contemporâneo. Trata-se de um imaginário marcado pelo embate entre as formas elevadas e os registros baixos da cultura nacional, em forte sintonia com os dilemas mais candentes da época. Praticada quase que exclusivamente por homossexuais e mulheres, essa escrita sugere uma erótica do limite, como se o risco de vida tivesse se tornado condição primordial do desejo. The obscene literature produced in the country over the last quarter century has mobilized a repertoire of fantasies peculiar to the urban sensibility of contemporary Brazil. It consists of gamut of images whose defining characteristic is the clash between the elevated forms and lower rungs of national culture, finely attuned to the most pressing dilemmas of the day. Undertaken almost exclusively by homosexuals and women, this type of writing suggests an eroticism on the edge, as if putting one's life at risk had become the primordial condition of desire. This text will explore the affinities among the thematic and formal particularities of this repertoire.

O ensaio tem por objetivo refletir sobre a utilidade do conceito de não sincronia, na educação, entre desigualdades de gênero e raça. Para tanto, apresenta e discute o perfil de estudantes e candidatos/as ao Programa Internacional de Bolsas de Pós-Graduação da Fundação Ford no Brasil, propondo interpretações referentes à sobrerepresentação feminina no ensino superior e na pós-graduação. Termina alertando sobre a necessidade de se abrir o debate sobre o melhor desempenho educacional das mulheres no contexto atual de discussão sobre ação afirmativa no ensino superior para negros e indígenas

The essay is a reflection on the usefulness of the concept of non synchrony between gender and racial inequalities in education. It presents and discusses the profile of the students and candidates in the International Fellowships Program of the Ford Foundation in Brazil, proposing interpretations with respect to the over-representation of women in higher education and in graduate studies. It ends by calling attention to the need to open up the discussion about the better educational performance of women in the present context of the debate on affirmative action in higher education for blacks and the indigenous population.

As transformações observadas na educação e na moda durante os anos de 1942-1945, da participação do Brasil na Segunda Guerra mundial, são analisadas por intermédio dos estilos e perfis criados pela Legião Brasileira de Assistência para as voluntárias. Examino os cursos, os serviços e as atividades criadas pela instituição a fim de envolver e preparar as voluntárias para revelar os estilos e perfis femininos que emergem no cenário nacional e mostrar como a guerra refletiu e influenciou o comportamento e o vestuário femininos.

The transformations observed in education and in fashion between 1942-1945, the years in which Brazil took part in Second World War, are analyzed through styles and profiles created by Brazilian Legion of Assistance for the volunteers. The courses, the services and the activities created by the institution with the aim of involving and preparing the volunteers will be analyzed so as to reveal the styles and female profiles that emerge from the national scenario and show how the war reflected and influenced female behavior and clothing.

Estudar as representações sobre as questões de gênero no parlamento é observar um espaço fundamental para as lutas políticas feministas, mas onde são poucas as vozes femininas. É também buscar entender os limites impostos pelas próprias dinâmicas do campo político a determinadas pautas, dentre as quais podemos incluir as questões de gênero. Este artigo pretende discutir as representações dos deputados e das deputadas brasileiras em relação à mulher, através da análise das representações da condição feminina nos discursos proferidos no plenário da Câmara dos Deputados durante as sessões dedicadas ao Dia Internacional da Mulher entre 1975 e 2006.

Congress and its current representations about gender are crucial spaces in feminist political struggles, but where there are few female voices. In these spaces, we can observe the limitations that the dynamics of the political field impose on certain issues, including gender. This paper discusses how female and male members of congress make their representations about women, analyzing the representations of the female condition present in speeches made in the plenary assembly of Brazilian Chamber of Deputies, in the course of the sessions held on International Women's Day (March 8th), between 1975 and 2006.

O texto trata da militância de mulheres de classes populares em clubes de mães, Comunidades Eclesiais de Base e Pastorais da Igreja Católica. A diferenciação entre "líderes" e demais participantes, e as motivações e os interesses específicos ao engajamento e à militância como "líder" são compreendidos a partir da análise das retribuições à atividade militante e suas relações com o exercício da liderança e com o conjunto de significados ligados à ação militante.

This paper covers the militancy of popular class women within Mothers' Clubs, Ecclesiastical Communities and Pastorals of the Catholic Church. Such militancy implies a differentiation between "leaders" and the other participants. This differentiation is defined by specific motivations and interests related to the commitment and militancy as "leader" in these forms of association. These motivations and interests can be understood by analyzing the rewards for militant activities and their relationships with the exercise of leadership and with the meanings associated with militant action.
