Personality Rights and the Jetztzeit: an analysis based on theses XVI and XVIII on Walter Benjamin’s concept of history

Abstract

This work aims to analyze two fragments of Walter Benjamin’s wirke - namely theses XVI and XVIII - as a paradigm of definition about the concept of personality, which presents itself with a dubious nature in the rule of law. Since Personality Rights have a defense of an intrinsic character to the individual, present themselves with a means of jusnaturalistic determination to be defined in a juspositivist rationalism. The present work does not intend to exhaust the topic but to present a hypothesis that should be deduced through theoretical-bibliographic presentation.
