Com base numa tipologia de formas de construção constitucional e com ênfase nos processos de constitucionalização chega-se a um conjunto de princípios básicos para vincular a construção constitucional às exigências da democracia. A análise concentra-se simultaneamente na reconstrução de casos históricos e no exame crítico das teorias relevantes. Especial atenção é dada às reivindicações do modelo norte-americano como exemplar. Os processos em andamento de mudança constitucional na Europa do Leste também são discutidos.

On the basis of a typology of forms of constitution making and with emphasis on the constitutionalization process a set of basic principles for linking constitution making with the demands of democracy is put forward. The analysis deals both with the reconstruction of historical cases and with the critical examination of relevant theories. Special attention is given to the claims concerning the exemplary character of the American model. The ongoing processes of constitutional change in Eastern Europe are also discussed.

Examina-se a questão das cláusulas que impõem restrições à mudança constitucional. Discutem-se as principais interpretações dos problemas e paradoxos que emergem quando a questão é vista da perspectiva de exigências democráticas. Argumenta-se que clásulas super-constitucionais são aceitaveis desta perspectiva quando protegem os princípios democráticos da Constituição. Isto signfica que uma teoria coerente das cláusulas super-constitucionais deve basear-se na defesa das condições que permitam o auto-governo por indivíduos livres e iguais com base em procedimentos justos. Aplica-se isso ao caso da Constituição brasileira de 1988.

The question of the clauses imposing restrictions on constitutional change is examined. The main interpretations concerning the problems and paradoxes raised when the question is viewed from the standpoint of the democratic demands are discussed. It is argued that those clauses area reasonable from this perspective whenever they protect the democratic principles of the Constitution. This means that a coherent theory of the supra-constitutional clauses ought to have at its foundations the defence of the conditions which allow the self-government of free and equal individuals on the basis of just procedures. This is applied to the case of the Brazilian Constitution of 1988.

Passada a era em que às revoluções bastava invocar legitimidade e quando a legalidade estatal passou a ser a referência para mudanças revolucionárias, coloca-se a questão de se é possível pensar um processo revolucionário legal para além dos limites dos estados nacionais, portanto legal e mundial. Usando o seu critério de definição do político - a capacidade de identificar inimigos e agir de acordo -Schmitt argumenta que o Estado nacional não pode ser substituido por uma unidade mundial ("a humanidade não tem inimigos neste planeta") e que o exame dos obstáculos constitucionais contra a transferência do poder legal de um grupo político a outro levanta a questão de contra quem eles foram erigidos.

After the end of an epoch in which it was enough for revolutions to claim legitimacy and after a state-based legality has been put at the center of revolutionary changes, there arises the question of whether it is possible to conceive of a worldwide legal revolutionary process outside the limits of the national states. Using his criteria for defining the political - the ability to identify one's enemies and to act accordingly - Schmitt argues that the national state cannot be replaced by a world unity (u humanity does not have enemies on this planet") and that the examination of the constitutional obstacles against the transfer of legal power from a political group to another raises to question of against whom they have been erected.

A partir de uma reconstrução do decisionismo schmittiano e da análise de como ele deixa sua marca em termos básicos da sua concepção como os de democracia, soberania e ditadura, examina-se o pensamento de Schmitt à luz de suas intervenções teóricas e práticas nas questões constitucionais na Alemanha de Weimar e do nacional-socialismo. Examina-se especialmente como para Schmitt a unidade e hierarquia dos poderes políticos e do direito requerem um Estado forte e um comando centralizado, no lugar de um equilíbrio pluralista.

On the basis of a reconstruction of Schmitt's decisionism and of the analysis of its effects on key terms of his conception like democracy, sovereignty and dictatorship, Schmitts thought is examined regarding his theoretical and practical positions on the constitutional issues of Weimar's Germany and of National-socialism. Special attention is given to how for him the unity and the hierarchy of the political powers and of the law demand a strong State and a centralized command instead of a pluralistic balance.

Pontos básicos da trajetória intelectual de Habermas são reconstruidos à luz de seu confronto com Rawls. Assinalam-se os limites da pretensão habermasiana a uma universalidade superior à rawlsiana. Argumenta-se que o livro de 1962 sobre "mudanças estruturais da esfera pública" já encerra as questões que encontrarão desdobramento mais tarde, inclusive na "teoria da ação comunicativa" de 1981. O artigo vai no sentido de uma reconstrução crítica de alguns problemas centrais do programa de pesquisa de Habermas. No final, retoma-se o confronto com Rawls.

Basic points of Habermas' intelectual trajectory are reconstructed from the standpoint of his debate with Rawls. The limits of Habermas ' claims to a greater universality of his theory as compared with Rawls' are pointed out. It is argued that already in his book of 1962 about the "structural transformations of the public sphere" may be found the questions to be further developed in his other works, including his "theory of communicative action" of 1981. The article aims at a critical reconstruction of some central problems of Habermas' research program.

O desenvolvimento histórico de urna cultura do consumo é examinado pelo ângulo das suas dimensões políticas, com vistas a urna melhor compreensão das suas condições atuais. Especial atenção é dada às modalidades de organização da defesa dos direitos dos consumidores. Argumenta-se que determinadas novas tendências que o artigo assinala permitem pensar a cultura do consumo também da perspectiva de processos de expansão da cidadania, sem abandonar a ótica crítica.

The historical development of a consumer's culture is examined from the viewpoint of its political dimensions, in search of a better understanding of its present conditions. Special attention is given to the ways of organizing the protection of consumer's rights. It is argued that the even if viewed from a critical stance some new trends pointed out in the article allow us to link the consumer's culture with the growth of citizenship.

Neste artigo destinado ao exame crítico desses livros argumenta-se que, estando em jogo obras de um autor que se move no universo do marxismo (Ressentimento da dialética e O fio da meada, de Paulo Arantes) a disjuntiva remete a Adorno ou a Lukács, autores centrais para Arantes.

Where is the emphasis to be put, on the internal analysis in the strong sense of the word or on the historical conditions of the production of texts? Since what is in question are works by an author which is at home in the universe of Marxism (Ressentimento da dialética and O fio da meada, by the philosopher Paulo Arantes), it is argued in this article devoted to a critical examinations of these books that the opposition may be stated to be between two thinkers that play central roles in Arantes' works: Lukács and Adorno.
