“With who are your children?” Speeches and practices in court records and the conditions of intersection between racism, sexism and colonialism in a prosecution

Abstract:

In this article, I discuss, based on Fanon’s thinking and the analytical lens of intersectionality, the relationship between racism, sexism and the Brazilian criminal justice system. I take as a case study the prosecution of a Namibian woman, single mother and HIV carrier who was criminalized by international drug trafficking in Brazil, highlighting how race, class, gender and coloniality were presented in her trial. I propose, therefore, that the non-implication of judges to the criticisms that have been produced about the penal system, from Afrodiasporic epistemologies, is directly related to the way in which systemic advantages are crystallized in these spaces.
