This study examines the Individualized Education Plan (PEI, acronym in Portuguese) within the context of Brazilian legislation, highlighting its relevance to inclusive education. The research adopts a qualitative approach based on documentary review and analysis of the historical evolution of educational legislation. The findings indicate that, although there is no specific regulation governing the PEI in Brazil, several legal frameworks provide support for its implementation. However, the absence of clear guidelines compromises its standardization and effectiveness, hindering the consistent adoption of the instrument across educational institutions. The analysis points to progress in the recognition of the educational rights of students with disabilities; nevertheless, it identifies challenges related to the need for public policies that ensure ongoing teacher training and promote pedagogical practices adapted to the individual needs of students. It is concluded that the PEI is an essential tool for promoting equity in education, but its effectiveness depends on strengthening legal support and government backing to ensure its consistent implementation in educational settings. Therefore, the development of specific regulations becomes indispensable to guarantee the uniform, democratic, and effective application of the PEI, contributing to the construction of a truly inclusive educational system.
