Considering the fact that the rights of the patient must be, respected for all professionals involved in the health, this exploratory research was developed in order to analyse the position of doctors and nurses in face to dayle handle of these principles. The descriptive method was adopted and the technique of social investigation, in the University Hospital Pedro Ernesto in UERJ, from September to December 1994, towards na aleatory sample composed of 26 nurses and 24 doctors. A questionnaire containing 30 questions was handed out to the professionals to be answered. The reference embraced the ethical and legal principies, which determinate the human rights, the attitude of the professionals of health in the relation with the clients and the very rights of the pacient. According to the answers of the ones who answered, the most difficulty respected rights of the patient are the choice of the professionals who is giong to attend to him, explanation about diagnosis and prognosis, individual treatment. access to the handbook, participation in the planning of the treatment. the right to have a companion and to be kindly attended. Otherwise, the most respected rights are professional secret and watch, right to visits and to complain about and adequate treatment to his pathology.
